Donald Trump is seeking a venue change and judge recusal in his 2020 election case.
The former president said that it would be impossible for him to get a fair trial with Obama-appointed Judge Tanya Chutkan. The DC judge has a history of handing down harsh sentences for January 6 defendants – oftentimes issuing longer jail times than sought by prosecutors.
Trump’s team has floated West Virginia as a possible alternative venue.
This comes as Special Council Jack Smith’s legal team is seeking a protective motion to prevent Trump from sharing evidence about the case.
The request follows a Thursday Truth Social post by the former president where he said “IF YOU GO AFTER ME, I’M COMING AFTER YOU!” Prosecutors said the post was referring to those involved in the case “specifically or by implication.”
They say the post suggests Trump might share evidence on social media. Trump’s team fired back, accusing Smith of punishing political speech.
