Thursday, as former President Donald Trump was arraigned in Washington, D.C., over charges stemming from his efforts to overturn election 2020, legal experts questioned the validity of the case.

Much of the Special Counsel Jack Smith’s indictment hinges on the claim that Trump knowingly lied about election fraud. But liberal Attorney Alan Dershowitz said there’s no evidence this was actually the case.

At the same time, National Review’s Andy McCarthy said Smith is setting a dangerous precedent for charging Trump over his belief that Vice President Mike Pence could overturn the election.

McCarthy noted that belief was coming from the legal advice of Trump’s attorney, John Eastman, who was also charged in the indictment.

In addition, McCarthy said the case may have procedural problems, as Smith just charged Trump in the classified documents.

Smith says he would like the case to go to trial in the next few months.
