The U.S. might see another uptick in illegal immigration soon. Tuesday, a California federal judge temporarily blocked a Biden administration border policy meant to limit illegal entry into the U.S.

The policy turns away asylum seekers if they haven’t first applied for asylum in a country they traveled through on their way to the U.S. Judge Jon Tigar (Tiger) previously struck down a similar law under the Trump administration. He said U.S. law explicitly states that crossing the border illegally should not be a bar to asylum.

The Biden administration imposed the rule back in May ahead of the end of Title 42,  resulting in a sharp drop in illegal immigration.

Government officials fear border encounters will spike if the rule is lifted. Tigar’s ruling won’t go into effect for two weeks and the Biden administration is appealing the decision. The case is expected to go all the way to the Supreme Court.
