On May 3, House Oversight Chairman James Comer (R-Ky.) subpoenaed the FBI for a document that, according to a letter accompanying the subpoena, describes an “alleged criminal scheme involving then-Vice President Biden and a foreign national relating to the exchange of money for policy decisions.
Comer gave the FBI until noon yesterday to comply with the subpoena, but that time has come and passed. Rather than turning over the document, the FBI sent a six-page response to Comer detailing why they would not turn the document over.
“This letter responds to your subpoena, authorized on May 3, 2023, demanding the production of documents within one week. As this was your first communication with the FBI seeking this information, please know that the FBI is committed to beginning the constitutionally mandated accommodation process,” the letter states.
The FBI is committed to working to provide the Committee information necessary for your legitimate oversight interests, while also protecting executive branch confidentiality interests and law enforcement responsibilities. The FBI appreciates this opportunity to inform you of our confidentiality interests so that we can ‘seek optimal accommodation through a realistic evaluation of’ each other’s needs and ‘avoid the polarization of disputes. We are committed to working together through this process.
According to both Comer and Sen. Chuck Grassley (R-Iowa), the FBI’s response to the subpoena shows that the document does exist. Grassley posted a statement to his website that read,
While the FBI has failed to produce the specific document by the subpoena deadline, their offer to provide an accommodation process in response to our legitimate request indicates the document is real. So the question remains, what did the FBI do to investigate very serious allegations from an apparent trusted FBI source implicating then-Vice President Biden? Today’s letter from the FBI raises additional questions, including whether the FBI has an open investigation based on these allegations. The American people pay the FBI’s salaries, and they’re entitled to a fulsome response.
The document in question is an unclassified FD-1023 form. This form, according to the FBI letter to Comer, is “one of many forms the FBI uses to collect and catalog information for its law enforcement and national security work. This form is used by FBI agents to record unverified reporting from a confidential human source.”
The FD-1023 form in question relates specifically to President Biden and his alleged role in the bribery scheme, but the case against the Biden family runs deeper than that.
“The Oversight Committee has obtained thousands of pages of financial records related to the Biden family and their associates’ business transactions. Recently, the Committee revealed one deal that resulted in several members of the Biden family and their companies receiving over $1 million in more than 15 incremental payments from a Chinese company through a third party,” reveals a press release from the Oversight Committee.
The White House has denied all allegations and continues to accuse Comer of leading an “evidence-free, politically-motivated” investigation.
“House Oversight Committee Chairman James Comer is loudly and proudly broadcasting a press conference today to continue his long pattern of making absurd claims that President Biden has made governing decisions not in the interest of America, but of the Chinese Communist Party, using baseless claims, personal attacks, and innuendo to try to score political points,” wrote White House spokesperson Ian Sams in a memo provided to Fox News.
The White House has maintained throughout the investigation that President Biden was not aware of or involved in any of Hunter Biden’s business dealings.
Comer, on the other hand, has maintained that the business dealings between the Biden family and foreign entities have posed and continue to pose concrete national security risks.
