A federal judge has handed down a major win to the State of Texas.

A district judge out of West Texas is now barring the Department of Homeland Security from cutting razor wire along the southern border. It’s a temporary order that comes in response to a lawsuit filed by Texas Attorney General Ken Paxton, who claims federal officials have been destroying state property to allow illegal immigrants to enter the state.

Paxton says federal agents at one point used a forklift to remove sections of wire, which allowed over 300 illegal immigrants to cross the border.

DHS released a statement last week defending itself and saying it has a “responsibility under federal law” to protect migrants from injury. As a result, the judge is allowing exceptions in cases of medical emergencies.

The restrictions will remain in place ahead of a court hearing scheduled for Nov. 7.
