The Biden administration has settled a class-action lawsuit over family separation at the southern border.

The agreement was reached Monday between the federal government and the American Civil Liberties Union. It bars any future administrations from implementing the Trump-era policy of separating children from their alleged parents who crossed the border illegally.

Until 2018, Trump sought to criminally prosecute illegal border crossers. Since children can’t be held in criminal custody, they were given over to HHS. It’s estimated upward of 5,500 families were separated, resulting in a cascade of lawsuits.

The settlement allows families affected by the policy to apply for temporary legal status for three years and a work permit. They will also have access to temporary housing support for one year.
