It appears D.C. authorities have been unfairly arresting pro-life protesters. In August 2020, at the height of the BLM ratios, two pro-lifers were arrested “for chalking ‘Black Pre-Born Lives Matter’ on a public sidewalk.”

These pro-lifers were taking part in a protest organized by the Frederick Douglass Foundation and Students for Life of America. Organizers from those groups eventually sued the city, noting BLM protesters were not arrested for their chalk messages. At first, a lower court dismissed the suit.

But the D.C appeals court now says the city was unfairly enforcing its “defacement” ordinances, agreeing that throughout the summer of 2020 BLM protesters covered streets, sidewalks, and storefronts with paint and chalk. None of those demonstrators were arrested.

The D.C. Circuit ruling reads, “The government may not enforce the laws in a manner that picks winners and losers in public debates.”
