While the court battle over mifepristone continues, the Biden administration also proposed a new rule that “would ban medical groups and doctors from sharing information with authorities who are investigating illegal abortion practices.”
The proposal is part of the current administration’s declaration that it would do everything in its power to “protect” the ability for women to obtain abortions following the reversal of Roe v. Wade.
A fact sheet released by the White House states, “This rule would prohibit doctors, other health care providers, and health plans from disclosing individuals’ protected health information, including information related to reproductive health care, under certain circumstances. Specifically, the rule would prevent an individual’s information from being disclosed to investigate, sue, or prosecute an individual, a health care provider, or a loved one simply because that person sought, obtained, provided, or facilitated legal reproductive health care, including abortion.”
Though the White House insists that the ruling is about protecting “women’s reproductive rights,” language within the document reveals that the true purpose is to hinder investigations of illegal, elective abortions in pro-life states.
“The proposal appears to be an attempt to twist HIPAA to use it as a bludgeon against the Dobbs decision and interfere with cooperation with law enforcement,” former Health and Human Services Office of Civil Rights director Roger Severino warned. “It also could scare medical providers from cooperating with police in states where abortion is restricted.”
