Politico reports that President Biden is already staffing a commission for Supreme Court reforms, although the reports have not been confirmed by the White House.
The idea of “court packing,” or expanding the number of justices on the bench, was a talking point among Democrats during the 2020 Presidential election, after Amy Coney Barrett shifted the court to 6-3 conservative majority. Biden was apprehensive about giving a straight answer on whether he would “pack the court,” but promised to create a bipartisan commission in order to, in his view, fix the court system.

Biden said, “I will ask them to, over 180 days, come back to me with recommendations as to how to reform the court system because it’s getting out of whack.” In 1983, then Senator Biden commented on FDR’s attempt to expand the court, saying it was legal, but “was a bonehead idea. It was a terrible, terrible mistake to make.”
