A federal appeals court ruled that key Biden administration officials violated the 1st Amendment.

The 5th Circuit ruled on Friday that the White House, top health officials, and FBI likely suppressed free speech surrounding COVID-19 and elections. The judge called the actions “persistent and angry” and “on-the-whole intimidating” when Biden personnel pressured social media companies to remove certain posts.

The court banned the officials from influencing platforms to “remove, delete, suppress, or reduce” protected free-speech content.” That ruling applies to the White House, Surgeon General’s office, Centers for Disease Control, and FBI.

The White House says it is reviewing the decision and evaluating legal options. Any further appeals will send the case to the Supreme Court.
